On 3 March, Karanović & Partners organised a business briefing event titled “Tax Audit: Be Prepared”, bringing together clients and business representatives to discuss the legal framework and practical challenges of tax audits in Serbia.
The session was led by our Partner Andrej Jelenković, Senior Counsel Ljubisav Stojiljković, and Associate Aleksa Tomanović, who addressed key issues that taxpayers face in practice, including when a tax audit formally begins, what may trigger it, how to manage the process effectively, and what steps to consider following its completion.
The speakers outlined that tax audits are generally conducted under annual risk assessment plans adopted by the Tax Administration, but may also be initiated due to specific circumstances, such as VAT refund claims, amended tax returns, or cross-checks between business partners.
Particular emphasis was placed on the taxpayer’s rights and obligations during the audit, the importance of structured and controlled communication with tax inspectors, and the value of having clear internal procedures in place. The strategic significance of submitting comments to the tax audit report, while not mandatory, was highlighted as an opportunity to present arguments and additional evidence before a final decision is issued.
The discussion also covered potential implications of identified irregularities, including additional tax assessments, interest, enforcement measures, and, in certain cases, misdemeanour or criminal proceedings. Finally, the speakers outlined key considerations when filing an appeal against a tax decision, focusing on procedural compliance, proper establishment of facts, and correct application of substantive tax law.
The event concluded with a clear message: a tax audit should not be viewed as an isolated event, but as part of a continuous compliance cycle. Each audit outcome should serve as a basis for strengthening internal procedures, improving documentation practices, and enhancing overall tax risk management. The strong attendance and active participation throughout the session underscored the sustained relevance of this topic for our local business community.
