Dawn Raid conducted in Montenegro

Montenegrin Competition Agency announced earlier this month that it conducted a dawn raid on 25 July 2019 in the premises of providers of after-sales services for motor vehicles (including motorcycles), looking at the terms of guarantees, manner of service provision and spare parts sales. The dawn raid was conducted as a part of a formal investigation.

During raids the Agency performs an unannounced investigation of the parties’ business premises and gathers relevant information on potential competition infringements. Competition authorities across the region are increasingly relying on dawn raids in order to detect and prove potential wrongdoing in high-profile cases, with increasingly sophisticated forensic tools being utilised to process the data seized. The Montenegrin Agency had conducted several dawn raids within the last few years.

Dawn raids are a special investigation tool used by the Agency to perform on-spot checks of compliance of market players with the Competition Law.
